Article 3 – Applicability

3.1 These general terms and conditions apply to every offer made by Nivexo and every agreement concluded between Nivexo and a consumer via the webshop.

3.2 Before the agreement is concluded, these general terms and conditions will be made available to the consumer in an accessible manner.

3.3 The legal rights of consumers always remain applicable. Provisions in these terms and conditions cannot exclude or limit mandatory consumer rights.

3.4 If a provision of these terms and conditions proves to be wholly or partially invalid or unenforceable, the remaining provisions will remain in force.

Article 4 – The offer

4.1 Nivexo attempts to display products, prices, features, and images as clearly and accurately as possible.

4.2 Product images are intended to provide the best possible representation. Colors may vary slightly due to screen settings.

4.3 Apparent errors or mistakes in prices, descriptions, or other information do not bind Nivexo if it should be reasonably clear to the consumer that there is an error.

4.4 The total price and any additional costs will be shown to the consumer before placing the order.

Article 5 – Conclusion of the agreement

5.1 The agreement is concluded after the consumer has placed the order and Nivexo has confirmed the order.

5.2 The consumer will receive an electronic order confirmation after placing the order.

5.3 Nivexo takes appropriate measures for a secure electronic payment environment and processing of personal data.

Article 6 – Prices and payment

6.1 All consumer prices in the webshop include VAT, unless expressly stated otherwise.

6.2 Any shipping costs and other mandatory additional costs will be clearly displayed before the order is definitively placed.

6.3 Payment takes place via the payment methods offered during checkout.

6.4 Nivexo may change prices. Price changes do not affect orders for which an agreement has already been concluded, subject to legal exceptions.

Article 7 – Delivery

7.1 Nivexo will process and deliver orders with due care to the delivery address provided by the consumer.

7.2 The expected delivery time is stated on the webshop, product page, or during the ordering process.

7.3 If an order is delayed, Nivexo will inform the consumer about this where reasonably possible.

7.4 The risk of damage or loss of a product generally remains with Nivexo until the product has been received by the consumer or a third party designated by him, subject to legal exceptions.

7.5 If Nivexo cannot deliver within the agreed or legally applicable term, the consumer retains their legal rights regarding late delivery.

Article 8 – Right of withdrawal

8.1 For online purchases, the consumer generally has the legal right to withdraw from the contract for 14 days after receiving the product without stating any reasons, unless a legal exception applies.

8.2 Nivexo also offers a return period of 30 days, in accordance with Nivexo's Return Policy. This additional regulation does not affect the legal right of withdrawal.

8.3 To exercise the legal right of withdrawal, the consumer must clearly inform Nivexo within the applicable period that they wish to withdraw from the contract.

8.4 After withdrawal, the consumer must return the product within the legally applicable period.

8.5 The consumer may inspect and assess a product during the cooling-off period to the extent necessary to determine its nature, characteristics, and functioning.

8.6 If a product has been used beyond what is necessary to determine this, the consumer may be liable for the resulting depreciation.

Article 9 – Return costs and refund

9.1 The direct costs of a return shipment due to a regular withdrawal are for the account of the consumer, provided this has been clearly communicated in advance.

9.2 If a product is delivered incorrectly, damaged, or defective and Nivexo is responsible for it, the consumer's statutory rights apply and necessary return costs will not simply be passed on to the consumer.

9.3 In the event of a valid full withdrawal, Nivexo will refund the legally due amounts, including, where applicable, the standard delivery costs of the original order.

9.4 Nivexo will generally use the same payment method for the refund as the consumer used to pay, unless otherwise agreed.

9.5 Nivexo may, to the extent legally permitted, withhold reimbursement until the product has been received or until the consumer has demonstrated that the product has been returned, whichever occurs first.

Article 10 – Exceptions to the right of withdrawal

The right of withdrawal may be excluded for, among other things, products for which there is a legal exception, such as:

  • products manufactured according to the consumer's specifications or clearly personal in nature;
  • products that spoil quickly or have a limited shelf life;
  • sealed products that are not suitable for return for health or hygiene reasons if the seal has been broken after delivery;
  • other products or services for which an exception applies according to applicable law.

An exception will only be applied to the extent permitted by law and if the consumer has been informed of this in advance where required.

Article 11 – Legal guarantee and conformity

11.1 The consumer has the right to the legal guarantee. A delivered product must comply with the agreement and possess the qualities that the consumer can reasonably expect from it.

11.2 If a product proves to be defective, the consumer has the rights arising from applicable consumer law.

11.3 Any additional commercial guarantee does not limit the consumer's legal guarantee rights.

11.4 In the event of a defective, damaged, or incorrectly delivered product, the consumer can contact Nivexo via info@nivexo.nl.

Article 12 – Complaints

12.1 Complaints about products, orders, or services can be submitted via info@nivexo.nl.

12.2 Nivexo will handle complaints within a reasonable period and attempt to reach a suitable solution together with the consumer.

12.3 Filing a complaint does not limit the consumer's legal rights.

Article 13 – Liability

13.1 Nivexo is not liable for damage resulting from incorrect, careless, or improper use of a product by the consumer.

13.2 Nivexo cannot be held liable insofar as performance is prevented by circumstances beyond Nivexo's reasonable control, to the extent permitted by law.

13.3 No provision in these terms and conditions is intended to exclude or limit liability when this is not permitted under applicable Dutch or European consumer law.

Article 14 – Personal data

14.1 Personal data will be processed in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).

14.2 More information about the processing of personal data can be found in Nivexo's Privacy Policy.

Article 15 – Intellectual property

All texts, images, logos, designs, and other content on Nivexo's website may not be copied, distributed, or commercially used without permission, unless otherwise provided by law or if the relevant rights belong to a third party.

Article 16 – Changes

Nivexo may amend these general terms and conditions from time to time. For an order, the terms and conditions applicable at the time the agreement was concluded generally apply, unless an amendment is legally necessary or otherwise validly agreed upon.

Article 17 – Applicable law and disputes

17.1 Dutch law applies to agreements between Nivexo and consumers.

17.2 This choice of law does not affect mandatory consumer protection to which a consumer is entitled under the law of their country of residence.

17.3 Nivexo and the consumer will first attempt to resolve a dispute through mutual consultation.

17.4 If this is not possible, a dispute may be submitted to the competent court under applicable law.
